The 10-day mandatory minimum cannot be suspended by the judge. Higher BAC tiers and aggravating factors (minor in the vehicle, accident, refusal) raise the penalties further. Second-offense DUI within 5 years can also be charged as a felony in certain BAC tiers, which moves the case to Superior Court.
