# Can you get a DUI on a bike in Rhode Island?

Yes, it is possible. Rhode Island's DUI statute, R.I. Gen. Laws § 31-27-2, applies to anyone who "drives or otherwise operates any vehicle," and state law defines a bicycle as a vehicle. Under § 31-19-3, a person riding a bicycle or an e-bike is subject to the same duties as the driver of any other vehicle, which includes the DUI chapter. Charges against cyclists are much less common than against drivers, and some penalties written for motor vehicles, like license suspension and ignition interlock, fit a bike case awkwardly. That gives a defense lawyer real room to argue. If you were stopped on a bike, take it as seriously as a car DUI and talk to a lawyer before your arraignment.
